Yaniv Levinson is an experienced attorney in both Israel and New York, specializing in companies and business-commercial law. With a proven track record of managing mediation procedures across a wide range of civil and commercial law cases, Yaniv has particular expertise in the business sector, including commercial and hi-tech industries.

Yaniv's extensive business experience includes more than 20 years working with hi-tech companies, including serving as Comvers' VP at ICQ and at the MAIL.RU company. He has also managed an investment fund for startups and has owned and managed companies in website management and promotion, as well as medical tourism.

Yaniv brings his rich business experience, legal expertise, and extensive experience in mediation to every case he handles. He has served as a mediator in dozens of commercial cases, including disputes between companies, partners, and shareholders, international disputes between local and foreign companies, and real estate disputes.

Yaniv graduated with honors from the University of Haifa, where he earned a degree in law and aconomy. He is licensed to practice law in Israel and New York.

Commercial mediation allows parties to settle disputes outside of court, under confidentiality and secrecy, through a non-binding process that only becomes binding if the parties reach an agreement and decide to bring it before a court for approval.

The mediation process can save parties a lot of money, stress, and valuable time involved in managing a legal process in court and allows them to reach a mutually desired settlement that optimally reflects their needs and interests in the conflict.

A voluntary and non-binding process - the goal of mediation is to manage the conflict settlement process between the parties through a voluntary agreement with the assistance of a professional mediator whose objective is to assist the parties in resolving their dispute.

Each mediation process is voluntary, non-binding, and at any stage, either party can discontinue their participation in mediation and/or return the dispute to the court without being penalized.

Similarly, the mediator has no binding authority but rather advisory and directing authority to assist the parties objectively, wholeheartedly, professionally, confidentially, and under confidentiality in settling their dispute through voluntary agreement.

Confidentiality and secrecy of the process - the mediation process is carried out under confidentiality and secrecy. If the parties do not reach a voluntary settlement, they cannot present details of the mediation process and cannot disclose any information generated during the mediation. The parties always have the option to continue managing the dispute in court.

Right to consult with a lawyer - Parties to mediation have the right to consult with anyone they deem appropriate at any stage of the mediation process, including attorneys, but this is not mandatory. The parties can decide to conduct the process themselves or consult with their attorneys at any stage before signing the mediation agreement and successfully reaching a settlement.

The mediator - As mentioned, the goal of mediation is to manage a process for resolving the dispute between the parties through voluntary agreement with the assistance of a professional mediator. The mediator is committed to conducting the process with diligence, objectivity, and professionalism to assist the parties in reaching a mediated settlement through free negotiation, without having the authority to decide the dispute. The mediator may offer solutions to the dispute and propose settlement proposals, but does not have the authority to compel the parties in the process.

 

As a commercial mediator and businessman, I bring to the mediation process extensive experience in both commercial and legal trade. As both a commercial lawyer and a deputy CEO in high-tech companies, I can assist both parties in guiding and formulating the agreement as far as the parties are able to reach agreements in the mediation process. As far as the parties are able to reach agreements, they will be put in writing, signed, and become a binding agreement for all intents and purposes. The parties can also submit the agreement to the court for a court order to enforce the mediation settlement.

The price for one hour of mediation is 500 NIS per party, excluding VAT.

 

Power of attorney for individual 3,000 NIS

Power of attorney for couple 4,500 NIS
